State of Florida Residential Real Estate Law - If a builder does not complete your Home or Condo within a two year period can you easily get your down payment refunded?? I have a condo being built in the State of Florida and I have given the builder one extension and it does not look like he is going to meet the two years completion date that is required by State this time either - What are my options ?

Hi,

He should return the downpayment upon demand. If not, you'll have to sue him in small claims court if it is within the money limits of the court or retain an attorney to sue him for it. Hopefully it won't come to that. Alternative if you need to move: assign/sell the contract (if allowed in the contract) to someone who can wait for the completion of the unit. Maybe you can make a profit :-).
