our tenants washing machine (supplied by us but in writing that we would not maintain,reipair or replace) overflowed and flooded the bottom condo. who is legally liable for damages to the bottom condo.

If the lease specifically states that you are not responsible for the repair, maintenance, etc of the washer then the tenants are responsible (the washer is a luxury provided to the by you and something you did not have to leave there for their use) - perhaps they have tenants insurance that would help with the cost of the damage. OR perhaps you have some type of homeowners insurance that you could tap into seeking the deductible from the tenants.

Dear Shari

Right. You are not responsible. My suggestion was to use your insurance and let them pay the deductible - but if the other condo owner is using their insurance then I would see that your tenant pays the deductible; however, you choose to recoup that money. I believe that is fair and reasonable for all.
